These Terms of Use (“Terms of Use”) set forth the legally binding terms on which users may access, register, and/or utilize the AresQED Fitness Academy website, mobile application, and associated digital platforms (collectively, the “Platform”), operated by AresQED Wellness Private Limited, a company incorporated under the laws of India with its registered office in Tirupati, Andhra Pradesh (“We”, “Our”, “Us”, or the “Company”).

This electronic record is generated by a computer system and does not require any physical or digital signatures. It is published in compliance with the Information Technology Act, 2000 and the rules made thereunder.

By accessing or using the Platform, you unconditionally accept these Terms of Use and our Privacy Policy (together, the “Agreement”) and confirm that you are legally competent to enter into this Agreement.

I. APPLICABILITY

These Terms apply to all users of the Platform, including:

End-Users: Individuals accessing or booking services
Partners / Service Providers: Trainers, gyms, studios, or wellness professionals

II. PLATFORM SERVICES

Fitness training programs under AresQED Fitness Academy
Digital fitness content, live and on-demand sessions
Membership plans (monthly, quarterly, annual)
Third-party gym and wellness access (if applicable)
E-commerce products and merchandise
Appointment booking and community features

Services are provided directly by AresQED or through verified Partners. AresQED acts as a facilitator and does not guarantee third-party services.

III. ELIGIBILITY & USER RESPONSIBILITIES

You must be 18+ years of age or supervised by a guardian
You confirm medical fitness to participate
Use of services is at your own risk
Misuse of memberships may result in suspension without refund

IV. MEMBERSHIPS & PAYMENTS

Fees exclude applicable taxes
Memberships are non-transferable and non-refundable
Auto-renewal applies unless cancelled
Pricing may be revised at AresQED’s discretion

V. USER ACCOUNT & SECURITY

Accurate registration details are mandatory
You are responsible for account security
One user = one account

VI. INTELLECTUAL PROPERTY

All content on the Platform is the exclusive property of AresQED or its licensors. Users receive a limited, non-commercial license only.

VII. DISCLAIMERS & LIMITATION OF LIABILITY

Services are provided “as is” without warranties. AresQED shall not be liable for indirect, incidental, or consequential damages.

VIII. GOVERNING LAW & DISPUTE RESOLUTION

Governed by Indian law. Courts at Tirupati, Andhra Pradesh shall have exclusive jurisdiction.

IX. COMMUNICATIONS

You consent to receive service and promotional communications. You may opt out by emailing support@aresqed.com.

X. CHANGES TO TERMS

AresQED reserves the right to update these Terms. Continued usage constitutes acceptance.
