TERMS AND CONDITIONS

This document is an electronic record in terms of the Information Technology Act, 2000 and the rules made thereunder, as applicable, and the amended provisions pertaining to electronic records. This electronic record is generated by a computer system and does not require any physical or digital signatures.

Please read these Terms and Conditions (“T&Cs”) carefully along with the Aresqed Terms of Use and Privacy Policy (collectively referred to as the “Agreement”) before purchasing or availing any services or products offered by Aresqed Fitness Academy.

1. ABOUT ARESQED

Aresqed Fitness Academy (“Aresqed”, “we”, “us”, “our”) is a fitness, wellness, and performance-based training organization originating in Tirupati, Andhra Pradesh, India, providing professional fitness coaching, nutrition guidance, martial arts training, wellness programs, and related services through online and offline modes.

2. SCOPE & APPLICABILITY

These T&Cs govern the terms under which businesses, corporate entities, institutions, academies, gyms, housing societies, and bulk purchasers (“Corporate Members”) may purchase or procure services (“Offerings”) from Aresqed for their End Users.

The Offerings may be availed:

• Online (website, video platforms, digital tools)
• Offline (academy sessions, partner locations)
• Hybrid formats

Corporate Member’s engagement constitutes acceptance of these T&Cs.

3. OFFERINGS

• Group or personal fitness training
• Martial arts, boxing, taekwondo, athletic & hypertrophy programs
• Nutrition guidance and body analysis
• Wellness education, podcasts, workshops
• Fitness merchandise and apparel
• Customized programs agreed in writing

4. AVAILABILITY, NATURE & USAGE

• All Offerings are non-cancellable, non-refundable, and non-transferable
• Fees are payable irrespective of attendance or usage
• Accurate End User details must be provided

5. END USER CONDUCT & RESTRICTIONS

• No recording or redistribution of content
• No misuse or commercial resale
• Violations may lead to termination without refund

6. DATA & PRIVACY

Corporate Members confirm lawful consent from End Users for data sharing. Aresqed shall not be liable for misuse of End User data by Corporate Members.

7. DISCLAIMER OF WARRANTIES

All Offerings are provided on an “as is” and “as available” basis without warranties of any kind.

8. HEALTH & FITNESS DISCLAIMER

Participation involves physical exertion. Aresqed is not responsible for injuries unless caused by gross negligence.

9. INTELLECTUAL PROPERTY

All content is the exclusive property of Aresqed Fitness Academy and protected under Indian intellectual property laws.

10. LIMITATION OF LIABILITY

Total liability shall be limited to fees paid in the three (3) months preceding the claim.

11. INDEMNIFICATION

Corporate Members agree to indemnify Aresqed against claims arising from misuse or breach of these T&Cs.

12. GOVERNING LAW & JURISDICTION

Governed by the laws of India. Courts at Tirupati, Andhra Pradesh shall have exclusive jurisdiction.

13. GENERAL PROVISIONS

Includes Force Majeure, Assignment restrictions, Modification rights, Severability, and Waiver clauses.
